Welcome to EverStrongSF. These Terms of Service (“Terms”) govern your access to and use of the EverStrongSF mobile application, website, and related services (collectively, the “Service”), operated by EverStrongSF, LLC (“EverStrongSF,” “we,” “us,” or “our”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use the Service. By using EverStrongSF, you represent that you are legally capable of entering into a binding agreement.

 

2. Description of the Service

EverStrongSF provides fitness, strength training, coaching, scheduling, workout tracking, and related tools for individuals, trainers, and organizations. Features may evolve over time, and we reserve the right to modify or discontinue any part of the Service at any time.

 

3. Accounts and User Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your login credentials

  • All activities that occur under your account

  • Providing accurate and current information

You agree not to:

  • Share your account with unauthorized users

  • Use the Service for unlawful purposes

  • Interfere with or disrupt the Service or servers

We reserve the right to suspend or terminate accounts that violate these Terms.

 

4. Health & Fitness Disclaimer

EverStrongSF provides tools and information related to fitness and training for educational and informational purposes only.

 

You acknowledge that:

  • You are responsible for consulting a physician before beginning any exercise program

  • Physical activity involves inherent risks

  • EverStrongSF is not a medical provider

You use the Service at your own risk.

 

5. Payments and Subscriptions

If the Service includes paid features:

  • Fees are disclosed prior to purchase

  • Payments are non-refundable unless otherwise stated

  • We may change pricing with reasonable notice

Failure to pay may result in suspension or termination of access.

 

6. Data and Privacy

Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and protect your information.

If you authorize third-party integrations (such as Google Calendar), you grant permission for EverStrongSF to access and use that data solely to provide the intended functionality.

 

7. Intellectual Property

All content, software, trademarks, logos, and materials provided by EverStrongSF are the exclusive property of EverStrongSF, LLC or its licensors.

You may not:

  • Copy, modify, or distribute the Service

  • Reverse engineer or attempt to extract source code

  • Use our branding without written permission

 

8. User Content

You retain ownership of any content you submit (e.g., notes, workouts, comments), but you grant EverStrongSF a limited license to use, store, and display that content as necessary to operate the Service.

You are responsible for ensuring your content does not violate any laws or third-party rights.

 

9. Termination

We may suspend or terminate your access at any time, with or without notice, if you violate these Terms or misuse the Service.

Upon termination, your right to use the Service ends immediately.

 

10. Disclaimer of Warranties

The Service is provided “as is” and “as available.”

We make no warranties, express or implied, including but not limited to:

  • Fitness for a particular purpose

  • Accuracy or reliability of data

  • Uninterrupted or error-free operation

 

11. Limitation of Liability

To the maximum extent permitted by law, EverStrongSF, LLC shall not be liable for any indirect, incidental, consequential, or special damages arising from your use of the Service.

Our total liability shall not exceed the amount you paid to EverStrongSF in the preceding 2 months.

 

12. Indemnification

You agree to indemnify and hold harmless EverStrongSF, LLC from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

 

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

 

14. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
